Terms of Service
Last updated: October 2, 2026
These documents are operational terms for using DogDart at dogdart.com. They are not a substitute for advice from a licensed attorney in your jurisdiction. If you do not agree, do not use the Service.
1. Parties and acceptance
These Terms of Service (“Terms”) form a binding agreement between you (“you”, “User”) and the operator of the DogDart service, publicly contacted as Dogdart System Support (“DogDart”, “we”, “us”, “our”). The Service includes the website, APIs, accounts, credit system, templates, generation tools, library storage, and related features (collectively, the “Service”).
By accessing or using the Service, creating or using an account, purchasing or spending credits, uploading media, or clicking any acceptance control, you represent that you have read, understood, and agree to these Terms, the Privacy Policy, Acceptable Use Policy, Content & IP Policy, Coins & Refunds Policy, and Age & Safety Policy (together, the “Policies”). If you do not agree, do not use the Service.
2. Eligibility and age (21+)
The Service is strictly limited to individuals who are at least twenty-one (21) years old and who are legally permitted to access adult sexual content in their jurisdiction. By using the Service you represent and warrant that:
- you are 21 years of age or older;
- you are not accessing the Service from a place where adult AI content is unlawful;
- you will not allow any minor (under 18, and where relevant under 21) to access your account or outputs;
- all depicted subjects in prompts, uploads, and references are consenting adults 18+ (and you only request 21+ contexts where required by our Policies).
We may require age assurance, identity checks, or additional verification at any time. Failure or refusal may result in suspension or termination without refund except as required by law.
3. Accounts, security, and sessions
3.1 Account types
The Service uses registered username/password accounts. An account is required for credit purchases, balance tracking, generation, and library persistence across devices.
3.2 Credentials
You are responsible for safeguarding credentials and for all activity under your account. Notify us promptly of unauthorized use. We may treat actions taken with your credentials as authorized by you.
3.3 Accurate information
You must not impersonate others, create accounts to evade enforcement, or provide knowingly false information material to age, identity, or payment compliance.
3.4 One person, accountable use
Accounts are personal. Sharing accounts to distribute adult content to unknown third parties, especially minors, is prohibited and grounds for immediate termination.
4. The Service (AI generation)
DogDart provides tools to generate, edit, and store AI-assisted images and videos, including adult-oriented templates and prompts. Generation quality, latency, availability, model behavior, and cost estimates may vary. Features may change, be rate-limited, or be discontinued.
4.1 No guarantee of specific results
AI outputs are probabilistic. We do not warrant that outputs will match your prompt, be unique, be commercially usable, be free of artifacts, or avoid resembling third-party styles or persons.
4.2 Third-party infrastructure
Generation may rely on third-party model providers, GPUs, storage, CDNs, and payment processors. Their outages or policy changes may affect the Service. We may substitute providers without notice where reasonably needed to operate.
4.3 Credits are required
Most generation consumes DogDart credits. Quotes shown in the UI are estimates; final debit may differ based on model, duration, resolution, retries, or provider billing. See the Credits & Refunds Policy.
5. Your prompts, uploads, and library
You retain rights you already hold in prompts, negative prompts, reference images, and other materials you submit (“User Content”), subject to the licenses in the Content & IP Policy. You are solely responsible for User Content and for verifying that every person depicted is an adult who consented to the intended use.
Do not upload real photographs of anyone without documented adult consent. Do not attempt to create sexual content of minors, or of any person who appears to be under 18. Violations may be reported to authorities.
6. Payments, crypto, and taxes
Credit packages may be purchased by sending supported cryptocurrency (such as USDT) to the wallet address shown on your invoice. Blockchain confirmations, network fees, and exchange rates are outside our direct control. Invoices may expire. Credits are generally non-transferable and have no cash value except as stated in the Coins & Refunds Policy or required by law.
You are responsible for any taxes, duties, or reporting obligations arising from your purchases or use. Price displays may exclude processor or network fees paid by you at checkout.
7. Prohibited uses
You must comply with the Acceptable Use Policy. Without limiting that policy, you may not use the Service for CSAM or any sexual content involving minors; non-consensual intimate imagery; doxxing; fraud; malware; unauthorized access; or to violate applicable law.
8. Monitoring, suspension, and termination
We may review prompts, uploads, outputs, logs, and payment events for safety, abuse, fraud, and legal compliance. We may refuse, rate-limit, quarantine, delete, suspend, or terminate access, with or without notice, where we reasonably believe these Terms or law are violated, or where continued service creates risk.
Upon termination, your right to use the Service ends. We may delete library assets after a commercially reasonable period. Unused credits are handled under the Coins & Refunds Policy and are not an entitlement to cash payout.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT OUTPUTS WILL BE LAWFUL FOR YOUR INTENDED USE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DogDart AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO DogDart FOR CREDITS IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR USD $50 IF GREATER LIABILITY CANNOT BE EXCLUDED.
11. Indemnification
You will defend, indemnify, and hold harmless DogDart and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, outputs you create or distribute, your misuse of the Service, your breach of the Policies, or your violation of law or third-party rights.
12. Governing law and disputes
These Terms are governed by the laws of the jurisdiction designated by the Service operator (update this clause with your operating country/state before launch), excluding conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, unless mandatory consumer law provides otherwise. You and we waive class actions to the extent waivable by law.
13. Changes
We may update the Policies by posting a revised version with a new “Last updated” date. Material changes may also be signaled in-product. Continued use after the effective date constitutes acceptance, except where local law requires affirmative consent.
